Shop & Establishment Registration:

It’s not the most discussed compliance, but it is one of the most basic. In most states of India, any business, be it a retail store, salon, consultancy, restaurant or even a small home-based business that employs people, has to register itself under the Shops and Establishments Act.

Many business owners think this only applies to brick-and-mortar stores with a large shopfront. That’s not quite how it works. If you have a business location, even if it’s just a rented office, and you’ve got employees working there, you probably need to register.

The good news is, it’s not a difficult process. But as with most compliance requirements, ignoring or delaying it tends to lead to bigger problems later on – fines, penalties and in some cases issues with other registrations and licences.

What is Shop & Establishment Registration?

The Shops and Establishments Registration  Act is a state statute. Every state has its own version of it, but the basic idea is the same for all of them – to regulate the working conditions of employees in commercial establishments.

When you register under this Act, you are in effect notifying the local labour department that your business exists, where it operates, and how many people are employed there. And you get a certificate of Shop registration, which is basic proof of the existence of your business.

More people don’t know they have this certificate than they do – it is also used when opening a business bank account, applying for GST or trade licences, or onboarding some vendors and clients. This is one of those documents that quietly sits in the background but becomes relevant at key moments.

It includes details on working hours, weekly offs, overtime rules, holidays, and employee rights. It’s as much about protecting your employees as it is about legitimising your business.

Documents Required for Shop & Establishment Registration

Having these ready before you start will save you a lot of back and forth.

  • Owner / Business PAN Card: Identification and proof of business.
  • Aadhaar Card of Applicant: Used as proof of identity of the owner or authorised person.
  • Proof of Business Address – Electricity Bill, Rent Agreement or NOC from property owner as applicable to your premises.
  • Shop or Office Entrance Photo: Most states require a current photo of the shop or office entrance.
  • Details of Employees: Number of employees, their names and in some cases their working hours.
  • Business Name and Nature of Business: What you are called and what you do.
  • Certificate of Incorporation (if applicable): Typically required for companies and LLPs.
  • GST Certificate (if applicable): Some states may require this as supporting evidence.
